VOW Terms of Use

This Virtual Office Website (the “VOW”) is operated by the Fennessey Comeau Group (the “Brokerage”) under the rules of the Toronto Regional Real Estate Board (“TRREB”) and its data provider, PropTx. The VOW gives registered consumers access to MLS® listing data — including sold and pending history — that is not available on public websites. By registering for and using the VOW, you agree to all of the following terms.

Your acknowledgements

By registering, you acknowledge and agree that:

1. Consumer-broker relationship. You are entering into a lawful consumer-broker relationship with the Fennessey Comeau Group, RE/MAX HALLMARK FIRST GROUP REALTY LTD., for the purpose of accessing this VOW.
2. Personal, non-commercial use only. The data on this VOW is provided for your personal, non-commercial use only and may not be used for any commercial purpose.
3. Bona fide interest. You have a bona fide interest in the purchase, sale or lease of real estate, and you will use the VOW only in connection with that interest.
4. No copying or redistribution. You will not copy, redistribute, retransmit, scrape or otherwise reproduce any of the data on this VOW, except as necessary in connection with considering an individual property.
5. MLS® data ownership. You acknowledge that the MLS® database and the data displayed on this VOW are owned by, or validly licensed to, TRREB / the MLS® system and its member boards, and are protected by copyright.

Your account

Access is password-protected and personal to you. Your account is tied to one email address; do not share your password or let anyone else use your account. To activate your account you must confirm your email address using the link we send you — your confirmation also records your agreement to these Terms of Use. Passwords expire every 90 days and must be renewed through the password reset process. We keep registration records (your name, email address and account details) for at least 180 days after your password expires, and we may be required to produce registration records and an audit trail to TRREB if a breach of the VOW rules is suspected.

The data

Listing data is provided by TRREB (PropTx) and is deemed reliable but is not guaranteed accurate. Sold and pending information is shown for your personal research in connection with your own bona fide interest in buying, selling or leasing real estate. Automated access — including robots, spiders, scrapers and data-mining tools — is prohibited. We may suspend or terminate any account that misuses the data or breaches these terms, and TRREB may require us to do so.

Not a solicitation

Nothing on this VOW is intended to solicit buyers or sellers who are currently under a written agreement with another brokerage.

Changes

We may update these Terms of Use from time to time. The version in force is the one posted on this page; continued use of the VOW after an update means you accept the updated terms.
